A Grade A Customary Court sitting at Mapo in Ibadan has sentenced one Segun Akinwale, 28, to six months in the correctional centre over malicious damage and attempted stealing.
Delivering judgment, the court’s President, Mrs S.M. Akintayo, convicted and sentenced Akinwale based on his guilty plea and the evidence tendered against him.
After the summary trial, Akintayo said that she considered the prayer of the convict that the court should temper justice with mercy in sentencing him being a first time offender.
Akintayo consequently sentenced Akinwale to six months imprisonment or an option of N30,000 for count one.
Similarly, she sentenced him to six months imprisonment or an option of N30,000 for count two.
“However on account of his inability to pay the fine, the two sentences shall run concurrently,” Akintayo said.
Earlier, the prosecutor, Insp Ayodele Ayeni, told the court that the convict committed the crime on Feb. 11, at about 8.00 a.m., at Apata Quarters area, Ibadan, Oyo State.
Ayeni said that Akinwale broke into the home of one Mr Olayiwola Kupoluyi at House 7, Lane 3 Apata Quarters through the roof after damaging the ceiling.
He added that the complainant, Kupoluyi, arrived just in time and discovered that a burglar had entered.
According to Ayeni, the convict jumped into the nearby deep freezer in the sitting room in order to hide, but was immediately caught by the complainant.
The prosecutor said that Akinwale before then had removed some wire valued at N590, 000 added to the cost of damaged ceiling valued at N10, 000 totaling N600, 000.
Ayeni said that the offences contravene the provision of Sections 412 and 453 of the Criminal Code cap 38 vol. ii Law of Oyo State, 2000.
